These Terms of Use ("Terms") are a legally binding agreement between you and Chilorisa Team ("Chilorisa", "we", "us", or "our")
governing your access to and use of the Chilorisa mobile application and related services (collectively, the "Service").
The Service is intended for users aged 17 and older.
BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
Chilorisa helps you build better morning routines and habits by letting you:
Log wake-up times, set personal goals, and write morning notes
Earn streak badges and track achievements
View habit trend charts over time
Customize habits and targets
3. Eligibility (17+)
You must be at least 17 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
4. Account Registration and Security
To use certain features, you may need to create an account and provide information such as your name, username, and email address.
You are responsible for maintaining the confidentiality of your login credentials.
You are responsible for activities that occur under your account.
You agree to provide accurate information and keep it up to date.
5. Your Content and Inputs
"User Content" means content you submit through the Service, such as your notes, goals, profile details, support requests,
and any text or images you choose to upload.
You retain ownership of your User Content.
You grant us a limited, non-exclusive, worldwide license to host, store, process, and display your User Content only as necessary
to operate and provide the Service.
You represent that you have all rights necessary to submit your User Content and that it does not violate law or third-party rights.
6. Optional AI-Assisted Features (If You Choose to Use Them)
The Service may offer optional automated features that generate or enhance content based on text or images you upload ("AI Features").
Use of AI Features is optional. You control whether to upload text or images.
Uploaded text/images may be processed on our own servers outside your device to provide the AI Features.
We do not share your uploaded text/images with third-party AI providers for processing.
We do not use your uploaded text/images for marketing profiling or advertising purposes.
We do not perform facial recognition and do not use biometric identifiers.
Outputs from AI Features may be inaccurate, incomplete, or inappropriate for your situation. You are responsible for reviewing outputs
before relying on them.
7. Acceptable Use
You agree not to:
Use the Service for illegal activities
Interfere with or disrupt the Service, security, or networks
Attempt to gain unauthorized access to accounts or systems
Reverse engineer or attempt to extract source code except to the extent permitted by law
Upload malware or harmful code
Use the Service to harass, abuse, or harm others
Misrepresent your identity or submit content you do not have rights to use
8. Privacy
Our Privacy Policy explains how we collect and use information. By using the Service, you acknowledge you have read and understood our Privacy Policy.
9. Intellectual Property
The Service, including its software, design, and all associated content (excluding User Content), is owned by Chilorisa or its licensors and is protected
by intellectual property laws. These Terms do not grant you ownership rights in the Service.
10. Third-Party Services
The Service may interact with third-party services (for example, operating system features or platform services). We are not responsible for third-party services
and your use of them is subject to their terms and policies.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms,
pose a risk to the Service or other users, or as required by law.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILORISA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS,
DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILORISA'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO CHILORISA FOR THE
SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR, IF YOU PAID NOTHING, ONE HUNDRED U.S. DOLLARS (USD $100)).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Changes to These Terms
We may update these Terms from time to time. We will update the Effective Date above and make the revised Terms available through the Service or our distribution channels.
Your continued use after changes become effective means you accept the updated Terms.
15. Governing Law and Dispute Resolution (Binding Arbitration)
These Terms are governed by the laws of Chilorisa Team's principal place of business, without regard to conflict-of-law rules.
Any dispute, claim, or controversy arising out of or relating to the Service or these Terms shall be resolved by binding arbitration, except that either party may seek
injunctive or other equitable relief for alleged infringement or misuse of intellectual property or unauthorized access to the Service.
